General Terms and Conditions

Grumpy Kid Studio Inc. ("we," "us," or "our") operates the TinKiu brand and website (www.tinkiu.com) (the "Site"). By accessing or using the Site, you agree to be bound by the following terms and conditions (the "Terms"), including any policies referenced herein. If you do not agree, please do not use the Site.

1. Use of the Site

You agree to use the Site for lawful purposes only. You must not use the Site in any way that may damage, disable, or impair our services or interfere with any other party's use of the Site.

2. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will take effect upon posting on the Site. Your continued use of the Site constitutes acceptance of those changes.

3. Products and Availability

TinKiu offers design-led objects that may be produced in limited quantities. Availability is not guaranteed, and products may not be restocked once sold out.

We reserve the right to modify or discontinue products at any time without notice.

TinKiu does not offer custom designs, repairs, or resizing services at this time.

4. Orders and Pricing

By placing an order, you confirm that:

  • you are legally capable of entering into a binding contract
  • all information provided is accurate and complete

All prices are listed in United States dollars (USD) and are subject to change without notice.

We reserve the right to refuse or cancel any order, limit quantities per customer, and correct pricing errors, even after an order has been placed. If a payment has already been processed for a cancelled order, a refund will be issued.

Only one discount code may be applied per order. Discounts cannot be stacked or combined. We do not offer price matching.

We are unable to ship to PO Boxes. Please provide a full residential or business address at checkout.

Duties and Taxes: For orders shipping to the following markets, applicable duties and taxes are collected at checkout and remitted on your behalf — no additional charges will apply at delivery:

  • Australia and New Zealand
  • Canada
  • China
  • European Union
  • Hong Kong
  • Japan
  • Singapore
  • South Korea
  • Switzerland
  • Taiwan
  • United Kingdom

For all other international destinations (outside the US and the markets listed above), your order may be subject to import duties, taxes, and customs fees imposed by your country upon delivery. These charges are not included in our $35 USD flat shipping rate and are the sole responsibility of the customer. We have no control over these charges and cannot predict what they may be, as they vary by country and order value. By placing an international order outside these markets, you agree to be responsible for any such charges. We do not refund duties, taxes, or customs fees under any circumstances.

5. Returns, Refunds & Final Sale

All sales are subject to TinKiu's Shipping & Returns Policy, available at tinkiu.com/pages/shipping-returns. By placing an order, you confirm that you have read and understood that policy.

Memory Collection pieces are made to order and are non-refundable, non-returnable, and non-exchangeable under any circumstances.

The following are final sale and cannot be returned, exchanged, or refunded:

  • Memory Collection pieces
  • Sale and promotional items
  • All international orders shipping outside the US and Canada
  • Items marked as final sale at the time of purchase

For non-Memory Collection pieces, store credit may be issued within 10 days of delivery, provided the item is unworn and in its original packaging. Returns are processed through our returns portal at https://tinkiu.loopreturns.com/.

Cancellations are accepted within 24 hours of purchase, provided the order has not yet shipped or entered production. Once a Memory Collection piece enters production, the order cannot be cancelled.

6. Photo Submissions

For Memory Collection orders, customers are required to submit a personal photo during checkout. This photo is used solely for the purpose of creating your ring and is not shared, sold, or used for any other purpose without your explicit consent. Photos are stored securely during production and permanently deleted once your order has been fulfilled.

You may request a photo change within 24 hours of placing your order by contacting contact@tinkiu.com. After that window, your ring enters production and the photo can no longer be changed.

7. Privacy

We collect limited personal and technical information, such as IP address, browser type, and browsing activity, to operate and improve the Site.

When you place an order, we collect necessary information to process your transaction. We do not sell your personal data.

We may disclose information if required by law or to prevent fraud.

You have the right to request access to, correction of, or deletion of your personal data by contacting us at contact@tinkiu.com.

8. Cookies

The Site uses cookies to improve functionality and user experience. By using the Site, you consent to the use of cookies. You may adjust your browser settings to decline cookies, though this may affect site performance.

9. Intellectual Property

All content on the Site, including images, text, graphics, logos, and product designs, is the property of Grumpy Kid Studio Inc. or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or exploit any content without prior written permission.

10. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content or practices of these external sites.

11. Disclaimer of Warranties

The Site and all content, products, and services are provided "as is" and "as available," without warranties of any kind, whether express or implied.

We do not guarantee that the Site will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, Grumpy Kid Studio Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or products purchased through it.

13. Indemnification

You agree to indemnify and hold harmless Grumpy Kid Studio Inc. and its affiliates, directors, officers, and employees from any claims or liabilities arising from your use of the Site or breach of these Terms.

14. Termination

We reserve the right to terminate or suspend access to the Site at any time, without notice, for any reason.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Note: Review with a cross-border lawyer given US customer base before finalizing.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with TinKiu's Shipping & Returns Policy and Privacy Policy, constitute the entire agreement between you and Grumpy Kid Studio Inc. regarding the use of the Site.
